Terms of Service
PlainSight — May 25, 2026
1. Service Overview
PlainSight identifies underutilized information-based assets ("Digital Discards" or "DDs") within your business and provides strategic guidance toward monetization. Identification of a DD does not guarantee revenue.
2. Tier and Pricing
Minimalist ($0): 1 DD identified. 10% royalty on DD revenue. PlainSight recoups $97 upfront.
Standard ($97): 3 DDs identified. 20% royalty on DD revenue. Customer covers 1 recoup; PlainSight recoups on 2.
Premium ($997): 5 DDs identified. 30% royalty on DD revenue. No recoup deducted; customer collects immediately on all 5.
3. Royalty and Recoup
Royalties apply to revenue generated from identified DDs after recoup is satisfied. Recoup amount varies by tier. Royalty percentages and recoup terms are fixed at signup.
4. Intellectual Property
Customer retains ownership of all business information submitted. PlainSight retains ownership of its identification methodology and frameworks. No IP transfer occurs between parties.
5. Payment
Payment is processed at signup via Stripe. Refunds are not available after payment is confirmed.
6. No Guarantee
PlainSight makes no income, revenue, or profitability guarantees. Results depend on market conditions and execution.
7. Limitation of Liability
PlainSight shall not be liable for any damages arising from use of this service.
8. Termination
Either party may terminate this agreement at any time. Upon termination, PlainSight retains all royalties accrued prior to termination. Customer remains responsible for recoup obligations already incurred.
9. Indemnification
Customer agrees to indemnify and hold PlainSight harmless from any claims, damages, or losses arising from customer's use of the service or their monetization of identified Digital Discards.
10. Force Majeure
PlainSight shall not be liable for failure to perform due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, technical failures, or third-party service outages.
11. Modifications to Terms
PlainSight reserves the right to modify these terms at any time. Changes will be communicated via the email provided at signup. Continued use after notice constitutes acceptance.
12. Entire Agreement
This document constitutes the entire agreement between the parties and supersedes all prior agreements, representations, or understandings related to the subject matter herein.
13. Severability
If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
14. Jurisdiction and Dispute Resolution
This agreement is governed by the laws of the State of Colorado. Any dispute shall be resolved through binding arbitration under AAA rules. Both parties agree to arbitration as the exclusive remedy. This clause does not limit any statutory rights.
